How Do I Know Which Family Visa is Right for Me?

The family visas available to you will depend in part on the immigration status of the family member who is already living in the United States. Specifically, that family member must be either a U.S. citizen or a Legal Permanent Resident to sponsor another family member for a green card.

  • A U.S. citizen can sponsor a spouse, unmarried child (under age 21), an adopted orphan or (if the citizen is over 21 years old) a parent for an Immediate Relative (IR) family visa. Unlike some other types of visas, there are no numerical limits as to how many IR visas can be issued each year.
  • Numerically limited visas are available to a U.S. citizen's siblings (and their spouses and children), unmarried sons or daughters over 21 (and their children), and married sons or daughters (and their children). Citizens can also sponsor a fiancé(e) for a K1 visa.
  • Unlike a citizen, a Legal Permanent Resident cannot sponsor an extended family member for an IR visa, but can sponsor spouses, minor children and unmarried children over age 20. However, the families of U.S. citizens receive preference over the families of Legal Permanent Residents.
