Deportation and Deportation Defense

Your odds of being able to successfully fight your deportation will depend heavily on what has caused the government to attempt to deport you in the first place. Most deportations are the result of:

  • Illegal entry into the United States
  • Overstaying a visa / living in the U.S. without legal status
  • Being convicted of a serious crime

Unfortunately, U.S. immigration policy has become very strict in the last several years. Individuals are often separated from their families for lengthy periods of time. Unless you are able to ask for asylum through an appeal to the U.N. Convention Against Torture (CAT), or under the Hague Convention there is often little that can be done. A lawyer can prevent deportation in only a few cases.

Can You Appeal for Asylum?

Because the United States has signed the U.N. Convention Against Torture, the government cannot deport an individual to a country where he or she faces political oppression or torture as a result of his or her religion, race, ethnicity, gender or affiliation with a particular social group.

If you can show that you would face torture in your home country, you may be able to receive refugee status/asylum and halt the deportation. You should speak with a knowledgeable attorney to help decide which steps to take.
